Attention: Commercial packaging (secondary and tertiary, except pallets) accompanying household packaging is considered as household.

Household

Anyone who has packed or ordered the packaging of products in Luxembourg in order to sell them or place them on the Luxembourg market; or if some products are placed on the Luxembourg market and have not been packed in Luxembourg, the importer of the packed products with the exception of private persons  who  consume the products themselves.

Trade & Industry

All products made of any materials of any nature to be used for the containment, protection, handling, delivery and presentation of goods, from raw materials to processed goods, from the producer to the user or the consumer. 'Non-returnable` items used for the same purposes shall also be considered to constitute packaging. This includes sales/primary, grouped/secondary, and transport/tertiary packaging (cfr. definition in Directive 2004/12/EC).

All packages that are not related to household waste, are considered as non-household packaging (eg the transport pallets, metal drums for acid used in the industry).

Household

A household packaging is a packaging of products which are predominantly intended for normal household activities or a packaging that is similar, such as:

  • Packaging whose nature is identical or similar to household packaging, while having a vocation other than domestic;
  • The commercial packaging (secondary and tertiary, except pallets) accompanying household packaging.

Service packaging are household and similar packaging. They are characterized in that they are filled or manufactured at the point of sale. This is among others plastic shopping bags delivered by the supermarket, bread bags, paper sheets for wrapping flowers or make a gift box, trays, ...

Not mandatory

The presence of the Green Dot logo on packaging contributing to VALORLUX is not mandatory. This logo is allowed on all household sales packaging and similar but is not applicable on for the group and transport packaging (cfr. Secondary and Tertiary Packaging).

Part Legislation and specific items

The parties responsible for packaging have the following obligations:

  • To register to the Environment Agency
  • To take back packaging waste
  • To achieve the rates of recovery and recycling determined by the Grand-Ducal regulation (see targets)
  • To report yearly to the Environment Agency – Waste Department the recycled and put on the market quantities of packaging
  • To inform users of packaging, including consumers, on:
    • Opportunities for prevention of packaging waste;
    • Return, collection and recovery systems available to them;
    • Contribution to the reuse, recovery and recycling of packaging and packaging waste.

The Party Responsible for Packaging may fulfil its obligation individually or ask an accredited organization to do it for him. VALORLUX is, at the moment, the only accredited organization in Luxembourg. In the name of its members, VALORLUX aims at reaching the recycling and recovery rates imposed by the legislator. The Party Responsible for Packaging will meet its obligation as soon as he can prove having contracted this activity to the registered body. If it is not the case, the Party Responsible for Packaging must inform the Environment Agency – Waste Departement about how he intends to meet its recycling and recovery obligation.

A company established outside the Grand Duchy of Luxembourg may adhere directly to VALORLUX and declare the products it supplies to all its Luxembourg clients. In that case, the foreign company becomes directly liable to VALORLUX for the packed products it delivers to its clients in Luxembourg without however taking on the legal obligations that remain the duty of the local Party Responsible for Packaging as defined in the amended Grand Duchy Regulation of 31 October 1998.

VALORLUX asbl

  • To collect the licence fees from packers/fillers and importers
  • To reach the recovery and recycling targets for its members
  • To report its results regarding recovery and recycling, to the Environment Agency
  • To finance in an appropriate manner the cost of collection, sorting and recycling of HH packaging and similar packaging waste  
  • To stimulate the selective collection and recycling of HH packaging and similar packaging waste through communication campaigns towards consumers (B2C).
  • To undertake measures and actions to reduce the quantities of HH packaging and similar waste used by its members
  • To licence to use the Green Dot symbol in the Grand Duchy of Luxembourg

The grand-ducal Regulation amended on October 31st 1998 transposed European Directive 94/62/EC on Packaging and Packaging Waste as well as its March 2005 revision into national law.
