As an alternative T&I packaging can voluntarily participate in the Ecoembes system, considering that the Local Government handles its collection.

Packer/filler or seller of packaged goods, or “the persons responsible for the first placing of the packaged goods on the Spanish market”

All materials/products used for the containment, protection, handling, delivery and presentation of goods from the producer to the end-user and consumer.  This includes sales/primary, grouped/secondary, and transport/tertiary packaging (cfr. definition in Directive 2004/12/EC).
T&I packaging is the one that is in use and exclusive consumption in industry, commerce, services, or farms and livestock and therefore unsuitable for ordinary use and consumption in the private homes.

Companies joining Ecoembes have to use the Green Dot symbol on household packaging but in order to avoid problems with the rules governing the use of the Green Dot in other European countries, marking the Green Dot on transport packaging in Spain is voluntary.

Part Legislation and specific items

Household packaging
An Extended Producer Responsibility (EPR) has been implemented for household packaging which requires the packers/fillers and importers of packaged goods to deal with the end of life of their household packaging. There are three possibilities to implement this obligation:
1. A deposit system approved by the Autonomous Region(s). NOT in operation in any region of Spain
2. An individual recovery system whose recovery/control procedures are authorized by the Autonomous Region(s).

3. A shared responsibility to an industry-run collective system (through an accredited organism) approved by the Autonomous Regions (cfr. Ecoembes).

Trade & industry (T&I) packaging
Last owner is responsible on management of its waste.

Companies managing HH or T&I packaging are responsible to produce a “prevention plan” whose purpose is to minimize packaging waste, unless the tonnages of packaging waste they generate fall below the limits which are specified in the Decree3. Even if individual companies remain ultimately responsible for the implementation of these plans, accredited organisations or trade associations may prepare collective plans on behalf of their members.

To make it easier for packer/fillers to pass the cost on to the retail trade, the cost of the Green Dot must be shown on invoices.

Refillable beverage containers
The 2011 Waste Law transposing the Waste Framework Directive says that a deposit system for beverage containers (for refillable beer, soft drinks and water containers) will be introduced if it is economically and environmentally appropriate for more effective management of waste. There were some attempts to introduce a deposit system in Spain, but environmental and economic studies have contributed to put a stop to this option.

Ecovidrio:
The glass manufacturers have established their own accredited organization (Ecovidrio) to recover glass. Producers who primarily use glass, distributors and importers of products packed in glass, glass manufacturers and recyclers may be member of the organization. Ecovidrio also uses the Green Dot symbol. Ecoembes and Ecovidrio work closely and charge identical fees.

SIGRE:
The pharmaceutical producers have funded SIGRE which is a special recovery system for used pharmaceutical packaging. Consumers return the packaging waste and pharmaceutical products to retail pharmacies for recycling or energy recovery.

3 The limits are 250 tons for glass, 50 tons for steel, 30 tons for aluminium, 21 tons for plastics, 14 tons for board or composites, 16 tons for wood and 350 tons for all materials.

 

  • To reach the recovery and recycling targets for its members
  • To report its results regarding recovery and recycling, to the authorities
  • To develop collection and sorting systems in cooperation with the municipalities
  • To collect the licence fees from packers/fillers and importers
  • To finance the cost of collection, sorting and recycling of HH packaging waste
  • To stimulate the selective collection and recycling of HH packaging waste through communication campaigns towards consumers.
  • To support its members in their efforts to reduce the quantities of HH packaging they use. Since 1998 is elaborating HH prevention plans for its licensed companies.
